New France Telemarketing Rules

We would like to inform you about the recent French legislation concerning telemarketing calls, which could affect your operations in France.

The Decree n°2022-1313, dated October 13, 2022, introduces new rules for telemarketing calls in France, effective from March 1, 2023. To help you understand and comply with these regulations, we have summarized the key points below:

  • Telemarketing calls are permitted only from Monday to Friday, between 10 am to 1 pm and 2 pm to 8 pm. Calls are prohibited on weekends and public holidays.
  • The new rules apply to all consumers, regardless of whether they are registered on the “Bloctel” do-not-call list. However, these restrictions also apply to consumers who have an ongoing contractual relationship with the calling party but have not given explicit prior consent to be called for commercial prospecting purposes.
  • Consumers who have given their explicit prior consent to be called are exempt from these restrictions.
  • A consumer can only be contacted for commercial prospecting purposes up to four times per month (30 calendar days) by the same organization or a person acting on their behalf.
  • If a consumer expresses their disapproval of receiving telemarketing calls, the professional is required to refrain from contacting or attempting to contact the consumer for a period of 60 calendar days following the date of the consumer’s disapproval.
  • Non-compliance with these regulations can result in significant fines: €75,000 for individuals and €375,000 for legal entities.
